MP High Court dismisses Shah Bano’s daughter’s plea against Emraan Hashmi-Yami Gautam starrer ‘Haq’. The film, inspired by the Shah Bano case, will release on November 7, 2025.
The Madhya Pradesh High Court has rejected a plea filed by Siddiqua Begum Khan, daughter of Shah Bano, seeking to stop the release of the upcoming film Haq, starring Emraan Hashmi and Yami Gautam Dhar.
The petition claimed that the filmmakers had no right to depict events associated with Shah Bano without the consent of her legal heirs. Siddiqua Begum asserted that she inherited her late mother’s reputational rights and sought a ban on the film, citing concerns over privacy and portrayal.
Court’s Verdict
Justice Pranay Verma, presiding over the Indore Bench, dismissed the arguments, emphasizing that privacy and reputation rights do not extend beyond a person’s death and cannot be claimed as property by heirs.
The Court agreed with the filmmakers’ position that Haq is a fictionalized account inspired by the landmark Supreme Court verdict in Mohd. Ahmed Khan v Shah Bano Begum, which upheld the right of divorced Muslim women to claim maintenance. The film also carries a clear disclaimer stating it is dramatized and fictional.
The verdict stated: “Since the disclaimer clarifies the film is dramatized and fictional, based on a book and inspired by a Supreme Court judgment, it cannot be termed fabricated. As inspired fiction, creative liberties are permissible and do not amount to sensationalism or misrepresentation.”
Public Domain Information Supports the Film
The Court further noted that Haq relies largely on information already available in the public domain. Once an issue enters the public record, it becomes open for discussion and depiction in media and art. The petitioner was advised that any challenge to the film’s certification should have been raised with the Central Board of Film Certification (CBFC) instead of directly approaching the High Court.
