The Delhi government has officially permitted women to work night shifts in shops and commercial establishments, a move aimed at increasing workplace flexibility and opportunities. The decision, formally notified on October 23, 2025, comes after earlier approval from Lieutenant Governor VK Saxena and introduces specific rules under the Delhi Shops and Establishment Act, 1954.
Mandatory Consent and Working Hours
Under the new rules, women can work night shifts only after providing written consent. No employee is allowed to work more than nine hours a day, including time for meals and rest, or exceed 48 hours a week. Additionally, employees cannot work for more than five hours continuously without a break. Shift schedules must ensure that no employee is forced to work only night shifts.
Overtime and Compensation
Employees working overtime will receive pay at double the normal rate, in accordance with Section 8 of the Delhi Shops and Establishment Act. The notification also guarantees compensatory leave for work done on national holidays, along with weekly off days. Workers will continue to enjoy all legal benefits, including minimum wages, provident fund, insurance, and bonuses.

Safety, Security, and POSH Compliance
The Delhi government has emphasized safety measures for night shift workers. Employers are required to provide transportation, ensure proper security arrangements, and install CCTV cameras with footage preserved for at least one month. Additionally, employers must constitute Internal Complaints Committees (ICCs) under the Sexual Harassment of Women at Workplace (Prevention, Prohibition, and Redressal) Act, 2013, ensuring a safe and secure work environment for women.
