The legal action targets Meta’s in-app audio features, particularly “Original Audio” and “Reels,” which allegedly allow users to add Eminem’s songs to their videos without securing licenses or offering proper credit.
Alleged “Rampant and Knowing Infringement”
According to court filings, Meta initially tried to obtain licensing rights through Audiam, a digital royalty service. However, after Eight Mile Style declined, Meta allegedly proceeded to incorporate the music across its platforms regardless. The lawsuit describes Meta’s actions as “rampant” and “knowing infringement,” accusing the tech giant of “unauthorized storage, reproduction, and exploitation” of Eminem’s work.
The publishing firm is seeking statutory damages of $150,000 per song per platform, covering Facebook, Instagram, and WhatsApp. This multiplies to a total of $109.35 million. Eminem, through his legal team, is demanding a jury trial and a permanent injunction to stop Meta from using any of his music without explicit authorization in the future. The lawsuit also challenges the applicability of safe harbor protections under the Digital Millennium Copyright Act (DMCA), asserting that Meta should be held liable for knowingly facilitating copyright violations.
