UCC Rules Highlights
Scope – Applicable to the entire State of Uttarakhand, as well as residents of Uttarakhand living outside the State, except the Scheduled Tribes.
Authority – To implement UCC, SDM Registrar and Gram Panchayat Development Officer will be the Sub Registrar in rural areas. Whereas in Nagar Panchayat – Municipalities, the concerned SDM Registrar and Executive Officer will be the Sub Registrar.
Similarly, in the municipal corporation area, the municipal commissioner will be the registrar and the tax inspector will be the sub-registrar. In the cantonment area, the concerned CEO will be the registrar and the resident medical officer or the officer authorised by the CEO will be the sub-registrar. Above all, there will be a Registrar General, who will be a secretary-level officer and an Inspector General of Registration.
Duties of the Registrar General – If the registrar is not able to take action in the stipulated time, the matter will go from auto forward to the registrar general. Similarly, an appeal against the order of the Registrar or Sub-Registrar can be made to the Registrar General, who will dispose of the appeal within 60 days and issue an order.
Duties of the Registrar to decide the appeal against the order of the Sub-Registrar within 60 days. Those violating live-in rules or violating marriage laws will be reported to the police.
The duty of the Sub-Registrar is to examine all the documents and information within 15 days in general and three days in the immediate future, take a decision seeking explanation from the applicant, impose a fine for not applying on time or violating the rules, as well as to inform the police, as well as to inform the parents or guardians if the marriage information is not verified.
Registration of marriage
Marriages solemnized between March 26, 2010, and the date of implementation of the Code, must be registered within the next six months.
Marriages taking place after the implementation of the Code must be registered within 60 days from the date of marriage
Applicants’ rights
If the Sub Registrar- Registrar does not take action on time then online complaint can be lodged.
An appeal against the rejection order of the Sub Registrar can be made to the Registrar within 30 days.
An appeal against the rejection order of the Registrar can be made to the Registrar General within 30 days.
Appeals can be filed through the online portal or app.
(Live-in)
The live-in relationships established before the implementation of the Code will have to be registered within one month from the date of implementation of the Code. Whereas the live-in relationships established after the implementation of the Code will have to be registered within one month from the date of entry into the live-in relationship.
Live-in termination – One or both the partners can terminate the live-in relationship through online or offline mode. If only one partner applies, the registrar will accept it only after confirmation from the other.
If a woman gets pregnant in a live-in relationship, it is mandatory to inform the registrar. It has to be updated within 30 days of the birth of the child.
Divorce –
While applying for divorce or annulment of marriage, details of marriage registration, decree of divorce or annulment of marriage, court case number, date of final order, details of children, copy of final court order.
Will based succession
Will can be made in three ways. By filling a form on the portal, by uploading a handwritten or typed will or by uploading a three minute video of the will being spoken.
