Supreme Court Quashes FIR Against Elvish Yadav in Snake Venom Case: Legal Relief for YouTuber

The Supreme Court of India has quashed the FIR against YouTuber and Bigg Boss OTT 2 winner Elvish Yadav in the alleged snake venom case.

Elvish Yadav was booked for the alleged use of snake venom at a Noida rave party in November 2023 and was arrested in March 2024.

 The Bench, comprising Justice MM Sundresh and Justice N Kotiswar Singh, examined the applicability of the NDPS Act and the Wildlife (Protection) Act in the case.

The Court noted that the alleged psychotropic substance was not listed in the NDPS Act schedule, and no substance was recovered from Yadav himself.

Under Section 55 of the Wildlife (Protection) Act, prosecution must be initiated through a complaint by an authorised officer; the FIR filed did not meet this requirement.

The Court observed that offences under the Indian Penal Code were linked to an earlier complaint that had already been closed.

On these legal grounds, the Supreme Court quashed the FIR but allowed competent authorities to initiate fresh proceedings following proper legal procedure.
