Atishi criticises the five-day judicial custody of Ashutosh Ranka and Saurav Das, calling the situation worse than the Emergency.
The detention of Cockroach Janata Party (CJP) members Ashutosh Ranka and Saurav Das has triggered a political row, with the Aam Aadmi Party (AAP) strongly opposing the decision to send the two leaders to five days of judicial custody. Delhi Assembly Leader of Opposition Atishi criticised the action, describing the situation as worse than the Emergency imposed in 1975.
The controversy began after the two CJP members were detained following a Tricolour-related incident at Jantar Mantar in Delhi. A Special Executive Magistrate (SEM) court subsequently ordered five days of judicial custody for both leaders, prompting criticism from several opposition figures.
Atishi Targets Centre Over Five-Day Judicial Custody
Reacting to the court’s decision, Atishi took to social media platform X to express her displeasure. She said it was shocking that Ashutosh Ranka and Saurav Das had been sent to jail for five days over hoisting the Indian national flag.
In her post, Atishi addressed Prime Minister Narendra Modi and said the situation was worse than the Emergency. Her remarks added to the growing criticism from AAP leaders, who have questioned the action against the two CJP members.
Atishi on Ashutosh Ranka and Saurav Das has become a key topic in the political debate, with opposition leaders drawing parallels between the incident and restrictions on civil liberties during the Emergency.

Saurabh Bharadwaj Calls the Action Dictatorial
Before Atishi’s response, AAP leader Saurabh Bharadwaj also criticised the detention. In a post on X, he said that sending Ashutosh Ranka and Saurav Das to five days of judicial custody for hoisting the national flag at Jantar Mantar was an example of dictatorship.
Bharadwaj’s remarks reflected the party’s broader opposition to the court’s decision. AAP leaders have argued that the incident raises questions about freedom of expression and the right to protest.
Sanjay Singh Questions the Government
AAP Rajya Sabha MP Sanjay Singh also targeted Prime Minister Narendra Modi over the issue. He questioned whether India was witnessing conditions similar to British rule and alleged that the two leaders had been jailed for raising the Tricolour and chanting “Bharat Mata Ki Jai.”
Singh warned the government against taking action that could be perceived as an attempt to silence young people. He also claimed that the detention would not stop the youth from expressing their views or displaying the national flag.
These remarks represent the AAP leaders’ political allegations regarding the case.
Why Were Ashutosh Ranka and Saurav Das Detained?
According to the information available, the Delhi Police Commissioner issued an order on October 11, 2026, removing Jantar Mantar from the list of designated protest sites.
Despite the restriction, three CJP members reportedly reached Jantar Mantar on October 13. They allegedly crossed barricades and closed iron gates to enter the premises, where they raised the Tricolour and shouted slogans.
The police subsequently detained the three individuals and registered a case involving alleged criminal trespass and violation of prohibitory orders.
The members were then produced before a Special Executive Magistrate court. The court sent Ashutosh Ranka and Saurav Das to five days of judicial custody over alleged violations of bail bond conditions.
The third member, Ajinkya Shinde, was conditionally released. According to the supplied details, he was required to furnish a bail bond of ₹5,000 and comply with a condition not to disturb public order for six months.
CJP to Discuss Its Next Course of Action
The detention has intensified the political exchange between AAP and the Centre. The party has criticised the decision and compared the situation to the Emergency, while the police case concerns alleged unauthorised entry and violations of restrictions at Jantar Mantar.
Atishi on Ashutosh Ranka and Saurav Das has drawn attention to the wider political implications of the case, particularly the debate over protest rights and the display of the national flag.
CJP is expected to discuss its next steps regarding the detention of its members. Further developments will depend on the legal proceedings and any action taken by the concerned parties.
