New Delhi: The legal battle over the iconic 1989 Bollywood song has intensified as the Tirchi Topiwale copyright dispute between veteran filmmaker Rajiv Rai and the makers of Dhurandhar: The Revenge is now set for a full trial. The case revolves around the alleged unauthorised recreation of the evergreen track Tirchi Topiwale from the 1989 film Tridev.
What began as a mediation attempt in the Delhi High Court has now escalated after talks failed, pushing the Tirchi Topiwale copyright dispute into a formal courtroom hearing scheduled for May 8.

The Tirchi Topiwale copyright dispute involves Trimurti Films, owned by Rajiv Rai, which has filed a case against Jio Studios and Aditya Dhar’s B62 Studios.
The production house claims that the song Tirchi Topiwale, originally featured in Tridev, was recreated without proper licensing or permission in Dhurandhar: The Revenge. The new version, titled Rang De Lal (Oye Oye), features updated vocals and arrangement by composer Shashwat Sachdeva and appears in the film’s climax as part of its official soundtrack.

According to the legal petition, Trimurti Films asserts ownership of both the musical composition and the original sound recording of Tirchi Topiwale. The Tirchi Topiwale copyright dispute alleges that the recreated version amounts to unauthorised reproduction and public communication of copyrighted material.

The Delhi High Court had earlier directed both parties to explore mediation, but after no settlement was reached, the matter has now been listed for a regular hearing.
Rajiv Rai Calls It ‘Theft’
In the ongoing Tirchi Topiwale copyright dispute, Rajiv Rai has strongly criticised the use of the song in the new film. In an interview, he described the recreation as “theft” and claimed that altering and reusing the track in another film without permission amounts to double infringement.
Following his remarks, the court has also cautioned Rai against making public statements that could influence the case while it remains sub judice.
Case Moves to Trial Stage
With mediation failing, the Tirchi Topiwale copyright dispute will now proceed to a detailed legal hearing. Meanwhile, Dhurandhar: The Revenge, directed by Aditya Dhar, continues its theatrical run, with the recreated song still part of its official soundtrack.
The case is being closely watched in the film industry, as it could set important precedents for how classic Bollywood songs are reused and licensed in modern cinema.
